Terms of Service

1. Agreement

These Terms of Service (“Terms”) form an agreement between you and eBrains Digital SRL, the Romanian company that operates NIMRAD AI Companion (“NIMRAD”, “the service”, “we”). By creating an account or using NIMRAD you accept these Terms. If you do not agree, please do not use the service.

2. Who can use NIMRAD

NIMRAD is designed for children aged 6–12. Because children of this age cannot enter into a binding contract on their own:

• An account may only be created by a parent or legal guardian who is at least 18 years old.
• The parent or guardian is responsible for the child’s use of the service, including supervision and the choice of when and how the child uses it.
• By creating an account, the parent or guardian confirms that they have the authority to accept these Terms on behalf of the child.

3. Accounts and access

We use a passwordless sign-in flow: you provide an email address and we send a one-time code. You are responsible for keeping your inbox secure and for all activity that takes place under your account. New accounts may need to be approved by an administrator before they can be used; we may pause, restrict, or suspend an account where this is necessary to keep the service safe.

4. What NIMRAD does — and what it is not

NIMRAD is an AI learning companion. It tries to give short, clear, age-appropriate answers using voice and text. It is an educational aid for curiosity and conversation; it is not a substitute for parents, teachers, doctors, therapists, or any other professional. Answers are generated by an AI model and may sometimes be incomplete or inaccurate. Important decisions should always be checked with a trusted adult or qualified professional.

5. Acceptable use

You agree not to:

• use NIMRAD for anything illegal, harmful, or contrary to the safety of children;
• attempt to bypass content-safety guardrails, prompt the model into producing harmful content, or extract its underlying instructions;
• attempt to access other accounts, scrape the service, or interfere with how it runs (rate-limit evasion, automated abuse, security testing without permission);
• upload or send content that is unlawful, hateful, threatening, sexual, or otherwise inappropriate for children;
• resell, sublicense, or commercially exploit the service without our written agreement.

We may remove content, restrict features, or terminate accounts that violate these rules.

6. Content and intellectual property

The NIMRAD app, its design, code, brand and characters are the property of eBrains Digital SRL and its licensors and are protected by intellectual-property laws. You receive a limited, personal, non-transferable right to use the service for its intended purpose. AI-generated answers are provided to you for personal, non-commercial use within the service.

7. Subscriptions and paid features

Some features may be free, others may require a subscription or a usage limit. Where prices, billing terms, or limits apply, they will be shown clearly before you commit. If you are a consumer in the EU, your statutory rights, including the right of withdrawal where applicable, are not affected by these Terms.

8. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

9. Service changes and availability

We work hard to keep NIMRAD running, but we cannot guarantee that the service will always be available, error-free, or uninterrupted. We may add, change, or remove features over time, and we may carry out maintenance or updates without prior notice when this is needed for security or stability.

10. Liability

To the fullest extent permitted by law, NIMRAD is provided “as is”. eBrains Digital SRL is not liable for indirect, incidental, special or consequential losses, or for loss of profits, data, or opportunity arising out of your use of the service. Nothing in these Terms limits any liability that cannot be limited by law — in particular, liability for fraud, gross negligence, personal injury or any rights you have as a consumer.

11. Termination

You can stop using NIMRAD at any time and ask us to delete your account. We may suspend or terminate an account if these Terms are seriously or repeatedly broken, if it is necessary to protect children or the service, or if we are required to do so by law.

12. Governing law

These Terms are governed by the laws of Romania. If you are a consumer, you also benefit from the mandatory protections of the law of the country where you live, and you may bring proceedings before the courts of that country.

13. Changes to these Terms

We may update these Terms as the service evolves. When we make material changes we will update the “Last updated” date above and, where appropriate, ask you to review the new version the next time you sign in.
